HomeMy WebLinkAboutItem 13 Transfer of City Properties to Springfield Utility Board said Properties Being Developed and in use by the Utility BoardAGENDA ITEM SUMMARY Meeting Date: 7/21/2014 Meeting Type: Regular Meeting Staff Contact/Dept.: Len Goodwin/DPW Chris Moorhead/DPW Staff Phone No: X3685/X1011 Estimated Time: Consent Calendar S P R I N G F I E L D C I T Y C O U N C I L Council Goals: Maintain and Improve Infrastructure and Facilities ITEM TITLE: TRANSFER OF CITY PROPERTIES TO SPRINGFIELD UTILITY BOARD, SAID PROPERTIES BEING DEVELOPED AND IN USE BY THE UTILITY BOARD ACTION REQUESTED: Authorize City Staff to prepare Deeds to transfer ownership of 4 City properties to the Springfield Utility Board and also authorize City Staff to prepare an Easement and a “Right of First Offer Upon Sale” Agreement appurtenant to an additional City property, for the Springfield Utility Board’s benefit. ISSUE STATEMENT: 4 properties that are being utilized by the Springfield Utility Board for water distribution tanks and buildings for machinery have been found to be remaining in the ownership of the City of Springfield. These properties should be transferred to the Utility. There is an additional property that the Utility had been operating upon with the belief that they owned it. Again it does remain in the ownership of the City of Springfield, but the Springfield Utility Board has only requested that an easement for their benefit, and a development agreement for both the City’s and the Utility’s future benefit to be granted. Memorandum from Office of City Attorney DISCUSSION/ FINANCIAL IMPACT: There are 4 properties that have been developed by the Springfield Utility Board with water distribution facilities (3 water tanks and machinery sheds) and which have existed in the developed conditions for over 25 years. These properties were deeded to the “City of Springfield” either before the existence of the Springfield Utility Board, or mistakenly deeded to the “City of Springfield” even though it was directly mentioned in the deed that the properties were to be used for water distribution facilities. (the customary deed designation is “City of Springfield, a municipal corporation action by and for the Springfield Utility Board.”) In addition there is one property, which is adjacent to 2 Springfield Utility Board properties, that has been used by the Utility for test wells and possible new water distribution. It was deeded to the City of Springfield before the existence of the Springfield Utility Board. The Utility has requested an easement over this property, and an agreement that if the City decides to sell the property, the Utility would be given the first option to purchase. Additionally the City and the Utility could decide to sell all 3 of these adjacent properties together, for the purposes of greater development potential and value. These properties are: (in order as they are referenced to above) Tax Lot 800 (180203); off S. 58th St; contains water tank Tax Lot 801 (180203); off S. 58th St; contains water tank Tax Lot 3600 (18020223); off S. 70th St; contains machinery Tax Lot 3700 (18020223); off S. 70th St; contains water tank Tax Lot 1600 (17032524); off Q St. at 16th; contains test well (abandoned)
