HomeMy WebLinkAboutResolution 2014-21 06/16/2014RESOLUTION NO. 2014 -21 A RESOLUTION OF THE CITY OF SPRINGFIELD ADOPTING JURISDICTIONAL TRANSFER AGREEMENT NO. 792, OREGON 126 BUSINESS: EUGENE ECL — McVAY HIGHWAY NO. 225 SECTION, McKENZIE HIGHWAY, STATE HIGHWAY NO. 15 LANE COUNTY TO THE CITY OF SPRINGFIELD; AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE JURISDICTIONAL TRANSFER AGREEMENT. WHEREAS, the McKenzie Highway is under the jurisdiction and control of the Oregon Transportation Commission. McKenzie Highway, State Highway No. 15 is also designated State Route OR 126 Business. WHEREAS, by the authority granted in Oregon Revised Statute (ORS) 190.110, 366.572 and 366.576, the City may enter into cooperative agreements with the state for the performance of work on certain types of improvement projects with the allocation of costs on terms and conditions mutually agreeable to the contracting Parties. WHEREAS, by the authority granted in ORS 366.395, the State may relinquish title to any of its property not needed by it for highway purposes to City, subject to such restrictions, if any, imposed by deed or other legal instrument or otherwise imposed by State. WHEREAS, the State maintains a state route system to assist the traveling public in their travels. Designated routes may be composed of both state highway and local roads. Designation and elimination of state routes are under authority of the Oregon Transportation Commission. WHEREAS, the City is the land use planning authority for Glenwood, a part of the City of Springfield located between Interstate highway 1 -5 and the Willamette River, and has adopted the Glenwood Refinement Plan to guide.the future development of Glenwood, WHEREAS, this segment of the McKenzie Highway, also known as Franklin Boulevard, is within the confines of the boundary of the Glenwood Refinement Plan, Phase I. The Glenwood Refinement Plan calls for Franklin Boulevard to be redeveloped as a multi -way boulevard, promoting both through traffic and multimodal connectivity to support and foster redevelopment of the area of Glenwood adjacent to Franklin Boulevard. WHEREAS, the City has applied for $6 million in Statewide Transportation Improvement Program funding to complete design and commence construction of the first phase of the redeveloped Franklin Boulevard and is prepared to obligate additional funds toward construction occurring in Fiscal Year 2016. WHEREAS, the City has requested that, to further accomplish and implement the goals and objectives of the Glenwood Refinement Plan, ODOT transfer jurisdiction of this segment of the McKenize Highway to the City. WHEREAS, for this purpose and for the further purpose of furthering the development of a state highway system adapted in all particulars to the needs of the people of the State of Oregon, State and City agree to eliminate from the state highway system a portion of the McKenzie Highway, as described below with more particularity in the jurisdictional transfer agreement No. 792 as Unit 1. WHEREAS, the Council has reviewed the above - referenced proposed Jurisdictional Transfer Agreement No. 792 attached hereto as Exhibit A and finds it satisfactory. WHEREAS, the Council wishes to provide the City Manager the authority to execute the proposed Jurisdictional Transfer Agreement No. 792. NOW, THEREFORE, BE IT RESOLVED by the City of Springfield as follows: 1. The Jurisdictional Transfer Agreement No. 792, Oregon 126 Business: Eugene ECL — McVay Highway No. 225 Section McKenzie Highway, State Highway No. 15 Lane County is hereby approved. 2. The City Manager is hereby authorized and directed to execute the proposed Agreement substantially in the form of Exhibit A on behalf of the City of Springfield with such changes as he determines are consistent with the will and intent of the Council, such determination to be reflected by his execution of the Agreement. 3. The City Manager is authorized to take all appropriate action to implement and carry out Jurisdictional Transfer Agreement No. 792. 4. This Resolution shall take effect upon its adoption by the Council and approval by the Mayor.
