HomeMy WebLinkAboutItem 04 LCOG IGA For Comcast Review AGENDA ITEM SUMMARY Meeting Date: 6/2/2014 Meeting Type: Regular Meeting Staff Contact/Dept.: Rhonda Rice/DPW Staff Phone No: 726-3655 Estimated Time: Consent Calendar S P R I N G F I E L D C I T Y C O U N C I L Council Goals: Provide Financially Responsible and Innovative Government Services ITEM TITLE: LCOG IGA FOR COMCAST REVIEW ACTION REQUESTED: To approve or reject the following motion: TO APPROVE THE IGA WITH LCOG FOR THE COMCAST REVIEW CONTRACT AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE IGA ON BEHALF OF THE CITY OF SPRINGFIELD. ISSUE STATEMENT: As part of the current franchise agreement with Comcast the governing body, LCOG, on behalf of the three participating agencies, has the option of conducting a financial review of Comcast’s method of calculating and reporting the franchise fee. Ashpaugh & Sculco, CPAs, PLC and David Olson of Cableworks will be conducting the review. This IGA will allow the City of Springfield to cover its cost of the review if a dispute arises with Comcast over payment of the review. ATTACHMENTS: 1. LCOG IGA DISCUSSION/ FINANCIAL IMPACT: Ashpaugh & Sculco, CPAs, PLC (“A&S”) has teamed with David Olson of Cableworks (collectively the “A&S Team”) to provide this review of the current cable TV franchises for Eugene and Springfield and urban Lane County. The jurisdictions have substantially identical franchises with Comcast of Oregon II, Inc. (“Comcast”) that are administered by the Metropolitan Policy Committee serving as a regional cable commission, Lane Council of Governments provides staff support. The A&S team will conduct a franchise performance review of Comcast under the provisions of the franchise agreements. If a dispute arises with Comcast over the payment of the review, estimated at $35k, then the three participating jurisdictions will cover the costs until the dispute is resolved. This agreement covers that contingency. The City of Springfield’s share of the consultant contractor would be 25.4% or about $10k, for the costs and expenses if not reimbursed by Comcast.
