AN ORDINANCE AMENDING THE SRPINGFIELD MUNICIPAL CODE,
SECTION 3.356 "SEWER CONNECTIONS — UNASSESSED PROPERTY"
TO ADD A NEW SECTION, SECTION 3.356(3)(c) REGARDING PROPERTY
DIRECTLY BENEFITED BY THE FRANKLIN /McVAY SANITARY SEWER
EXTENSION AND ADOPTING A SEVERABILITY CLAUSE
WHEREAS, the City. Council has determined that a special rate is appropriate for
properties directly benefited by the Franklin /McVay sanitary sewer extension, City Project No.
21080 to provide a reasonable and just fee based upon the size of the benefited properties.
NOW THEREFORE, THE CITY OF COUNCIL OF THE CITY OF SPRINGFIELD ORDAINS AS
FOLLOWS:
SECTION 1: Section 3.356(3) "Sewer Connections — Unassessed Property" is hereby
amended to add a new section 3.356(3)(c) which reads as follows:
"Section 3.356(3)(c) Unassessed Property along McVay Highway /Franklin Boulevard to
Nugget Way. Properties directly benefited by the Franklin /McVay sanitary sewer extension City
Project No. 21080 shall pay a fee based on square footage as determined and adopted by Council
resolution."
SECTION 2: Severability Clause. If any section, subsection, sentence, clause phrase or
portion of this Ordinance is, for any reason, held invalid or unconstitutional by a court of competent
jurisdiction, such portion shall be deemed a separate, distinct and individual provision and such
holding shall not affect the validity of the remaining portion hereof.
ADOPTED by the Common Council of the City of Springfield this 21 day of
APRIL . 2014, by a vote of 6 for and o against.
