Box 10066 Eugene, OR 97440 Bear Mountain Electric 85388 Dillard Access Road Eugene, OR 97405 RE: Change of Use at 1509 Mohawk Blvd. The City of Springfield Planning Division has received a copy of your building permit submittal (COM2007-00059). This building permit proposes to change a portion of a • building previously containing a beauty salon to restaurant use. Springfield Development Code 31.010 states, "Minimum Development Standards review shall apply to commercial, industrial and public land zoning districts where there is a change in use of a building or property." The code also goes on to state, "Where there is an addition, expansion or change in use of a building or property containing multiple uses,the property owner shall bring the entire property into compliance with the standards specified in Subsection (4) of this Section. However, required improvements shall be installed under the rule of proportionality, based on the number of businesses on the property. For example, if there are three businesses on the property and there is only one change of use, then only one-third of the improvements necessary for the entire property area shall be required to be completed for that use. If the property contains more than three uses, the Director and the property owner may enter into an agreement so • that as a use changes or expands, a percentage of the property shall comply with MDS • requirements with the intent that the total property will meet MDS requirements over time." • Planner; Livl • • • I have enclosed a copy of the Minimum Development Standards application and a fee schedule. Normally, the building permit is not issued until this process is complete; however the Planning division has approved their portion of the building permit for issuance with a condition that the MDS application be submitted and a percentage of the improvements to be completed before occupancy. These improvements will include the screening, covering, berming and connection to sanitary sewer of the dumpster areas used for the restaurant use on the site. This site is an a 5 Year Time of Travel Zone for the 16th and Q Street Wellhead Drinking Water Protection Overlay District and is regulated by SDC Article 17. This requirement is also necessary to comply with the Federal Clean Water Act. The MDS application looks at eight different criteria which are listed on the application. .
