DESCRIPTION OF PROPOSAL:
Construction of a detached Accessory Dwelling Unit in the north east corner of the lot behind an existing
detached garage. The parcel is located on the east side of 33fd Street north of Main Street. The parcel is
approximately 9,148 square feet with 75 feet of street frontage. The proposed ADU is 440 square feet
with a 120 square foot covered porch.
Criteria of Approval: In order to approve an accessory dwelling unit, the Director shall determine
compliance with all applicable standards of SDC Section 5.5-125 as specified below:
Development Standards:
A. The accessory dwelling unit shall meet all applicable standards in this Code including, but
not limited to: setbacks, height, lot coverage, solar access and building codes in effect at the time
of construction. i�

X Proposal complies when the following condition is met:
Condition 1: The detached garage and accessory structure shall not be taller than the primary
structure. The building permit submittal for the ADU shall show the primary structure height and the
proposed ADU structure height.
Condition 2: There is a 10' utility easement at the rear of the property containing an 8" sanitary sewer
line. The plot plan for the ADU shows the eave extending into this easement. The ADU must be
moved to the west so no portion of the building extends into this easement.
B. The minimum lot size to construct an accessory dwelling unit shall be as specified in Section
3.2-215 of this Article.

C. The accessory dwelling unit shall contain a kitchen, bathroom, living, and sleeping area that
are completely independent from the primary dwelling.

D. The square footage of the accessory dwelling unit shall not exceed 40 percent of the primary
dwelling exclusive of the garage. Within this standard, the minimum area shall not be less than
300 square feet. The maximum area shall not exceed 750 square feet.

E. When separate entrances to the accessory dwelling unit are proposed:
1. Only one (1) entrance may be located on the front or street side of each residence.
2. A hard surface walkway, a minimum of 3-feet in width, shall be required from the primary
entrance of the accessory dwelling unit to the street or walkway serving the primary
dwelling.

Section 16.070 of this Article shall be required.

I. Before final occupancy of the accessory dwelling unit, the property owner shall record a deed
restriction that states the property owner resides on the property and the accessory dwelling unit
shall not be sold separately from the primary dwelling unless lawfully partitioned.
X Proposal Complies when the following Condition(s) is/are met:
Condition 4: The applicant shall submit a completed, signed and notarized deed restriction for review
by the City Attorney's Office prior to the issuance of the building permit for the ADU.
Condition 5: The applicant shall submit a copy of the recorded deed restriction to the City before final
occupancy of the Accessory Dwelling Unit can be given.
(7) Design Standards: An accessory dwelling unit shall comply with the following standards, where
practicable:
a. Exterior finish materials shall be the same or essentially the same in terms of type,
size, placement and finish as the primary dwelling.
b. Roof pitch shall match the roof pitch of the primary dwelling.
c. Trim shall be the same in type, location and finish as the primary dwelling.
• d. Windows shall match those of the primary dwelling in terms of proportion (height
and width ratio) and orientation (vertical vs. horizontal).
e. Eaves shall project from the accessory dwelling unit addition the same distance as
the eaves on the primary dwelling.

X Proposal complies when the following conditions are met:
Condition 6: The building permit shall be submitted showing the following design standards for the
ADU:
a. The exterior finish materials shall be shown the same as the primary dwelling unit with wood
shingle siding and composition shingle roofing.
b. The roof pitch shall match the primary dwelling.
c. Trim shall be the same as shown on the primary dwelling unit.
d. Windows shall match those shown on the primary dwelling plan in proportion (height and width
ratio) and orientation (vertical vs. horizontal).
e. Eaves shall project the same distance as exist on the primary dwelling.
Conclusion: Staff finds the accessory dwelling unit complies with the criteria of SDC Section 5.5-
125 and approves the application with Condition(s) specified below:
The following conditions of approval must be met prior to Building Permit Issuance or Final
Building Occupancy (as stated):

DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS
This Declaration, made on the date hereinafter set forth by the undersigned
hereinafter referred to as Declarant
' Declarant is the owner of certain real property located in the City of
Springfield, County of Lane, State of Oregon as follows : (Insert legal
description or if lengthy reference Exhibit A and attach Exhibit A)
Declarant applied to the City of Springfield Development Services Department for
an accessory dwelling unit pursuant to Springfield Development Code 5 . 5-100, a
single-family accessory dwelling unit permitted in a low density residential _
zone.
Declarant states that Declarant resides on the real property and that it is the
primary and permanent dwelling place of Declarant excluding temporary absences
and temporary stays elsewhere' and said property is Declarant' s legal residence .
Declarant states that said accessory dwelling unit placed on the real property
shall not be sold separately from the primary dwelling unit unless the accessory
dwelling unit is placed upon another lot created from a partition approved by the
City of Springfield.
Declarant states that the real property described herein is and shall be held and
conveyed subject to these Covenants, Conditions and Restrictions all of which are
for the purpose of enhancing and protecting the value, desirability and
attractiveness of the property and complying with the requirements of Springfield
Development Code 5.5-100 .
Declarant states that these Covenants, Conditions and Restrictions shall be
perpetual and constitute covenants running with the land and shall be binding
upon Declarant, their heirs, successors and assigns and all persons claiming
under them.
Declarant further states that these Covenants, Conditions and Restrictions shall
not be amended, terminated, or modified in any way without the consent of the
City of Springfield filed in the Deeds and Records of Lane County Oregon.
