Will an Annexation Agreement be required? If so, what will the requirements be? A: The annexation is a Type IV land use application that requires public and stakeholder notification and a public hearing before the City Council. As a Type IV application, a pre-submittal (completeness review) meeting is required prior to acceptance of the full application submittal. Staff advises that an Annexation Agreement will be required for the subject properties. Among other things, the Agreement will outline cost apportionment and responsibility for extension of public utilities, dedication and construction of public streets, and extension of walkways and pathways. Q.2 Where are the public utilities to serve the project site, and do they have adequate capacity to serve development on the site? If not, what is the plan and funding source for extending/ upsizing the utilities? Will it be necessary to extend utilities to adjacent sites? A: Engineering to comment. Q.3 The Glenwood Refinement Plan outlines several new public improvement projects on and adjacent to the project site (reconstruction of Franklin Boulevard, roundabout at the Franklin Boulevard/Glenwood Boulevard intersection with a north leg road extension through the site, and a multi-use path). Please explain the extent, timing and the funding source for the planned public improvements on and adjacent to the site. If the timing is greater than a year out, how does this affect development on the project site? A: Engineering and Transportation to comment. Q.4 What special setbacks apply to the site (future right-of-way, public utility easements, Willamette Greenway, floodplain, riparian, etc.)? How is the roundabout design progressing? A: The Willamette Greenway and riparian setback will be applicable to the project area. Additionally, the site is within the mapped FEMA floodplain of the Willamette River. There is an access and utility easement along the east side of the property for the sanitary sewer pump station. Additional easements will be necessary along the existing and future public street frontages of the property, and possible internal to the site. Structures cannot be built atop or encroach across a public easement. Transportation to comment on setbacks from future Franklin Boulevard right-of-way and status of the roundabout project. Q.5 What other site constraints (building height, access locations, fire department service, etc.) have we not discussed yet? A: Building height setbacks will be required in accordance with the adopted Glenwood Refinement Plan. Above the 3rd story level, the upper stories need to be stepped back. SUB Water advises there is limited water supply on the north side of Franklin Boulevard, so water system upgrades may be necessary to serve the subject development site. Fire to comment on ladder truck access, alternate access to the building faces and the parking garage, and other emergency response issues. faved: plv,tennesceis; A! • • Heads Up Issues: • Staff understands there are some non-permitted drainage pipes that discharge directly to the Willamette River along the river frontage of this site. Capping and/or removing the drainage pipes will be necessary when development proceeds on the site. • Installation of the public walkway along the riverfront may be deferred initially because there is no connection point beyond the east boundary of the site. • Staff and the developer can examine viable "affiliated housing" provisions as the project advances. The Development Code language is intentionally open-ended such that a number of possible measures could be used to satisfy this requirement.
