•Dear Ms. Merriman:
This letter is in response to a request from The Planning and Zoning Resource
Corporation for planning and zoning information on the above stated property. The
zoning for this address is Community Commercial (CC). The Eugene-Springfield Metro
Area General Plan and the Gateway Refinement Plan designations are also Community
Commercial. The zoning of the properties surrounding the property are Community
Commercial to the north, Community Commercial and Low Density Residential across
Harlow Road to the south, Medium Density Residential to the east across Gateway Street
and the west of the property is bounded by Interstate 5 with the City of Eugene on the
other side of the freeway.
The property is not part of a Planned Unit Development. The property is within the
Drinking Water Protection Overlay District It is within the 10 to 20 year Time of Travel
Zone for the Sports Way Wellhead. A Locally Significant Wetland channel, listed on the

Natural Resources Inventory Map, exists on the west edge of the property adjacent to
Interstate 5.
The subject property is currently regulated by sections 3.2-300, 3.3-200, 4.3-117 and
5.17-100 of the Springfield Development Code. To my knowledge there are no open .
building or zoning violations on file for this property.
According to the Springfield Development Code regulations for this district the use of the
subject property is a permitted use upon completion of Site Plan Review. The subject
property was developed in accordance with an approved Site Plan Review and is legal

conforming to approved site plan. If any nonconforming issues exist with respect to
current zoning requirement; the subject property would be considered legal non-
conforming.
To my knowledge, there do not appear to be any variances, special permits, ordinances or
conditions that apply to the subject property.
In the event of casualty, in whole or in part, the structure located on the subject property
may be rebuilt in the current form.
The property was developed with Site Plan Review(Journal Number 88-03-35), which is
attached. Several other Site Plan Reviews and Modifications of Site Plan Reviews have
been processed for the Gateway Mall building and associated surrounding buildings since
this original review. Please let me know if you need any additional information other
than the original Site Plan Review.
We are unable to locate a certificate of occupancy for the project from our records. The
absence of a certificate of occupancy for the project is not a violation and will not give
rise to any enforcement action.
