Reference to the recorded Subdivision or Partition by name or reference number and blocks, lot/parcel numbers, where applicable Date Received: AUG 13 2013 Original Submittal- Revised 6/6/11 Liz Miller 4 of 4 • PLA Narrative Map Number 17-03-36-00 Tax Lots 500 & 600 The purpose of the proposed property line adjustment is to adjust a portion of the common line between the properties of Tax lots 500 (Parcel A)and 600(Parcel B) of Map 17-03-36-00 in order for said Tax lot 600 to encompass the buildings and areas that Springfield Utility Board (SUB) is presently utilizing. The eastern 275 feet(approximate)of the southern boundary of said Parcel B will be adjusted approximately 25 southerly, and the eastern boundary of said parcel will be adjusted approximately 140 feet easterly, as shown in the accompanying map. Parcel A is zoned Public Land and Open Space (PLO) and is being used by the City of Springfield for their Operations Division, storage,vehicle washing area and Fleet Mechanics Shop. Parcel B is zoned Heavy Industrial (HI), and is being used by SUB for their Water Service Center, Fleet Mechanics Shop, storage area, and as an electrical substation site. The proposed property line adjustment would not change any of these uses. There will be no new properties created in this property line adjustment. Access will be gained from a newly created joint access easement(included in submittal) along the previously vacated private S 18th Street. A new public utility easement (also included)will also be created simultaneously with the plat along the new eastern boundary. 5.16-125 Criteria • The Director shall approve, approve with conditions, or deny the Property Line Adjustment application. Approval or approval with conditions shall be based on compliance with the following criteria. The Property line Adjustment shall not: A. Create a new lot/parcel The proposed property line adjustment will not create any new lots or parcels. B. Create a landlocked lot/parcel The proposed property line adjustment does not create a landlocked lot or parcel. C. Reduce an existing lot/parcel below the minimum size standard or reduce setbacks below the minimum established by the applicable zoning districts in this Code Setbacks are met, as shown on the following page: Date Received: • • AUG 13 2013 • Original Submittal • • Parcel A,zoned PLO: Minimum lot size =.none Minimum frontage =none Building setback(front of lot) = 15 feet(Adjusted setback is greater than 80 feet) Minimum setback from frontage to parking = (no change at 20+ feet) Residential Parking setback = 15 feet, but DNA Parking and Driveway setback = 5 feet(is met in all places except for 50 foot strip in the very northeast corner of Parcel A, but no change is being made—see Section F below.) Building setback(front of lot) = 10 feet(no change at 16 feet) Parcel B,zoned Hi: Minimum lot size = 10,000 sf (Adjusted lot size:274,162 sf) Minimum frontage = 75 feet (Adjusted frontage is greater than 500 feet) Building setback(front of lot) = 10 feet(no change at 16 feet) There are no resulting reductions of minimum setbacks for Parcel B. • Though there is no specified setbacks for the side or back of lots, it is worthy to note that the zero lot line setback for a building on the original west line of Parcel 8 has been increased to 34 feet, and another building is now at 21.5 feet. D. Violate any previous conditions the Approval Authority may have imposed on the lots/parcels involved in the application. There is an Urban Renewal Plan on both Parcels A & 8 and also an Improvement Agreement and Application for Sewer Hookup on Parcel 8(Rec. #2001-069708), but neither of these are adversely affected by the property line adjustment. E. Detrimentally alter the availability of existing public and/or private utilities to each lot/parcel in the application or to abutting lots/parcels. There will be no detriment to utilities, but a new PUE will be of benefit and Is included in this packet. This PUE will take into account the sanitary sewer line that runs underneath one of the structures on Parcel B, and allow it to remain over said sewer fine while the structure exists, but upon it being removed, the structure will have to stay outside the border of the new PUE. F. Increase the degree of non-conformity of each lot, parcel or structure that is non- conforming at the time of application. The only nonconformity has to do with the landscaping of the Parcel A, but this situation is not increased at all by the proposed property fine adjustment. Conclusion: • The proposed property line adjustment application meets the intent of SDC 5.16-125 criteria. Easement Created. Additionally, the cost associated with any utility construction, maintenance, or repair that solely benefits Party 1 or Party 2 shall be borne solely by the benefitting party. 6. Binding Upon Successors. This easement and agreement are binding upon the heirs, administrators, executors, successors, and assigns of the respective parties herein and the covenants herein are intended to run with the land and any subsequent partition or subdivision thereof. 7.
