ITEM TITLE: CITY COUNCIL ADOPTION OF A RESOLUTION INITIATING
ANNEXATION OF FRANKLIN BOULEVARD AND A CITY-OWNED
PROPERTY ADDRESSED AS 4095 FRANKLIN BOULEVARD

REQUESTED:
The Council is requested to consider and adopt/not adopt the following resolution:
A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO
THE CITY OF SPRINGFIELD PURSUANT TO SECTION 5.7 OF THE
SPRINGFIELD DEVELOPMENT CODE.
ISSUE
STATEMENT:
Annexation of publicly owned rights of way and properties associated with Franklin
Boulevard is a high priority of the City Council to facilitate the extension of public
utilities and services along this corridor, to accommodate future Franklin Boulevard
transportation improvements, and to enable the redevelopment of Glenwood.

FINANCIAL
IMPACT:
Annexation of Franklin Boulevard would transfer legal jurisdiction within the rights
of way to the City of Springfield, but for the time being the street would remain an
Oregon Department of Transportation (ODOT) highway. Upon annexation of the
linear segments of public rights of way much of unincorporated Glenwood becomes
contiguous with the City limits, which is a pre-requisite condition for processing
requests for annexation to Springfield. Additionally, annexation of the Franklin
Boulevard public rights of way is an integral step in reinforcing the City’s
commitment to the planning and development of Glenwood after the recent
adoption of the Glenwood Refinement Plan.
Concurrently with annexing segments of Franklin Boulevard, staff is
recommending annexing a City-owned commercial property addressed as 4095
Franklin Boulevard – formerly operating as Tom’s Tapper Tavern. Annexation of
this property is a necessary and desirable step for future development or
redevelopment of the site.
Upon adopting the resolution, staff will prepare and distribute a formal annexation
application for review and comment by City departments, external referral agencies,
and adjacent property owners. Staff anticipates that the enacting Ordinance for the
Franklin Boulevard annexation will be presented to the City Council at a public
hearing later this spring.

Glenwood Franklin Boulevard Annexation:
Ownership Narrative
Explanation of what is shown on the ownership maps:
Franklin Boulevard was part of the Pacific Highway No. 1 and under the ownership of
the State of Oregon, by and through its State Highway Commission until its relocation in
1951, moving this section to the current location of Interstate No. 5. On September 12,
1951, the State entered into an agreement with Lane County which re-classed and
renamed these portions of relocated Pacific Highway No. 1. The first section was re-
classed as a Secondary State Highway, known as McVay Secondary Highway, and the
second section was re-classed as a Primary State Highway, known as an extension of the
McKenzie Highway No. 15. At this point in time, 1951, these portions which made up
Franklin Boulevard in its entirety within Glenwood, were in the ownership of the State of
Oregon, by and through its State Highway Commission, and remained in this ownership
as a result of this agreement. The location of the state owned right of way is depicted in
this 1951 agreement.
Between 1951 and present day there were several more right of way acquisitions. The
relevant later acquisitions and areas of ownership abnormalities are explained as follows:
There are 3 portions of right of way owned by Lane Transit District, as shown on
maps 17033443 and 17033432 which are included in the proposed annexation
area.
There is a portion of right of way that is a “Right of Way Easement” to Lane
County on map 17033431 which is included in the proposed annexation area.
There is a portion of the existing right of way that is identified as private land per
an Oregon Department of Transportation 2009 Survey on map 17033443. The
Survey identifies this portion as being an incomplete right of way widening
acquisition from a 1942 widening project. This area is not included in the
proposed annexation area.
There are several areas identified as State Owned Right of Way per various deeds
from 1965, 1966 and 1967. These are from a widening project for this section of
the Secondary highway.
There is a parcel inside the right of way boundaries that is identified as a State
Lease, and has no legal description, just a parcel area of 11,050 square feet. This
parcel is also identified as Tax Lot 1100 on map 18030340.

South of the McKenzie Highway bridge over the Willamette River; and being
